These Terms Governing Use of the Zuno.com Website ("Terms of Use") govern Zuno, Inc.’s relationship with its users and others who access the Zuno.com Website (“Site”). By accessing and/or using the Site, you agree to be bound by these Terms of Use.
Privacy. We are dedicated to protecting your privacy and encourage you to follow all instructions on the Site to ensure the privacy of your personal information. Here is a link to our full Privacy Policy
Security. Zuno has put in place security measures to protect against the loss, misuse and alteration of the information collected from our users. Our web servers are locked in cages in a highly secure internet data center. A 'firewall' (an internet security device) sits between the Zuno Site and the internet to help prevent any unauthorized user from accessing any data.
Your Content and Personal Data
Ownership Rights. You own all of the content and information you make available on the Site. If you believe that another user has infringed your copyrights in your content, or that your content has wrongfully been challenged as infringing, please follow the procedures noted in our Legal Matters section
License to Zuno, Inc. For any content you post on the Site, you grant us a worldwide, royalty-free, non-exclusive, transferable license to use that content in connection with the Site ("Usage License"). This Usage License ends when you remove the content, except for Content you may have added to a group card which is already in circulation before you remove content from the Site.
Deleted Content. Content that you delete will be archived for a temporary period but will no longer appear as posted by you. Content you may have added to a group card which is already in circulation will not be deleted.
Unsolicited Items. Any unsolicited material or comments you provide to Zuno, Inc. (“Zuno”) may or may not be used or accepted by Zuno, and may be sold, licensed or otherwise transferred in Zuno’s sole discretion with no acknowledgement, notice or compensation to you.
Prohibited Conduct
The following rules are designed to enhance the safety and enjoyment of all Site users and visitors. These rules will be enforced through various lawful means available to Zuno. The following actions are prohibited:
Unsolicited commercial communications (such as spam)
Electronic or automated harvesting of user information, such as scraping
Unlawful multi-level marketing or investment solicitations, such as a pyramid scheme
Transmission of viruses or other malicious code
Unauthorized use of another person’s account
Harassment or defamation
Excessive, unreasonable volumes of email messages to other users as determined in Zuno’s sole discretion
Posting content that features or promotes unlawful conduct, hate messages, pornography, violence, terrorism, nudity or sexual conduct
Interfering with the functioning of the Site or its support services
Promoting violations of these Terms of Use
Providing false information in account registration or false changes to account information or maintaining expired account information. Zuno has no obligation to investigate or correct any such inaccuracies.
Posting false or misleading information persons might rely on to their detriment in any way
Selling, licensing or sub-licensing a user’s account
Password sharing or providing others with account access
Using our copyrights or trademarks, or any confusingly similar marks, or other Zuno intellectual property without our written permission. You acknowledge and agree that the Zuno content including but not limited to (1) text, (2) software, (3) photographs, (4) graphics, (5) page layout (6) design presented through and as part of the Site, is protected by copyrights, trademarks, service marks, patents, trade secret law or other proprietary rights and laws and is the sole property of Zuno.
Using a name, logo or design that infringes another person’s intellectual property rights (Zuno may restrict your use of a name, logo or design that becomes the subject of any infringement claim)
Taking action or posting content on the Site that infringes or violates someone else's rights or otherwise violates the law, including copyright, trademark or patent violations and posting of third party content, including photographs of someone, without their permission. Zuno may remove any content that becomes the subject of an infringement or privacy invasion claim
If you infringe other people's privacy or intellectual property rights, we will disable your account when appropriate in Zuno’s sole discretion
Advertising or otherwise marketing controlled substances or mature content without appropriate age-based restrictions
Using the Site to conduct a contest, competition or raffle, except with prior written permission of Zuno and according to Zuno guidelines
Anyone under the age of 13 using the Site
Advertisements
We may feature sponsored services and communications without indicating that they are paid advertising.
We do not give your content or information to advertisers without your consent.
We do provide advertisers with non-specific information about site users and visitor trends and demographics. See our Privacy Policy for further details.
Amendments. Zuno may update its Terms of Use from time-to-time. Users and visitors to the Site are subject to the Terms of Use in effect at any given time.
Termination. If you violate these Terms of Use or their underlying policies, or if you jeopardize the integrity of the Site in any manner, we can stop providing all or part of the Site to you. We may also delete your account or disable your application at any time, with or without warnings or advance notice to you, if we believe in our sole discretion that you have violated these Terms of Use or their underlying policies or that you have jeopardized the integrity of the Site in any manner, whether or not you later prove that you did not do so.
Indemnification. You agree to indemnify, defend and hold harmless Zuno, its shareholders, officers, directors, subsidiaries, affiliates, and employees from any claim, demand, or damage (including reasonable legal fees and costs), due to or arising out of your use of or conduct on the Site.
Definitions
"Content" means anything you post on the Site that would not be included in the definition of "Information."
"Data" means content and information that third parties can retrieve from the Site or provide to the Site.
"Information" means facts and other information about you, including actions you take.
"Post" means post on the Site or otherwise make available to us.
"The Site" means the products and services we make available now or in the future, including through (a) our website at www.zuno.com and any other Zuno branded or co-branded websites and (b) other media, software (such as a toolbar), devices, or networks.
"Us," "we" and "our" mean Zuno, Inc., or if you are outside of the United States, Zuno’s nearest foreign affiliate.
"Use" means use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
